Please read these terms carefully before using MaxyonOps. They describe your rights and obligations as a user of the platform.
These Terms and Conditions govern access to and use of the MaxyonOps operations management software (hereinafter, "the Platform"), as well as the associated services offered by MaxyonOps.
By registering and using the Platform, you agree to be bound by these Terms. If you do not agree with any of the conditions set forth herein, please do not use the service.
Continued use of the Platform after changes to these Terms are published implies acceptance of those changes.
"Platform": the MaxyonOps SaaS operations management software, accessible online.
"User": any individual or legal entity that accesses the Platform using access credentials.
"Organization": the company or organization that contracts access to the Platform.
"Subscription": the active payment plan that grants access to the service features.
"Data": all information entered, generated or stored by Users during use of the Platform.
The Platform is designed exclusively for the operational management of cleaning service companies. Any use other than intended is expressly prohibited.
The User agrees to: (a) use the Platform in accordance with applicable law; (b) not attempt to access unauthorized areas of the system; (c) not reproduce, copy or redistribute the software without express authorization; (d) maintain the confidentiality of their access credentials.
Use of the Platform for unlawful purposes, to harm third parties, or to transmit malicious, deceptive content or content that infringes intellectual property rights is prohibited.
We reserve the right to suspend or cancel access to any account that violates these Terms, without prior notice in serious cases.
Each Organization is responsible for managing its Users' access. The account holder (owner or primary administrator) is responsible for all actions taken under their account and those of their users.
You must notify us immediately if you suspect unauthorized access to your account. We are not responsible for damages resulting from unauthorized use of your credentials if you have not taken reasonable security measures.
To use the Platform you must be at least 18 years old and have legal capacity to enter into binding contracts.
Registration data must be truthful, complete and up to date. It is your responsibility to keep this information current.
Access to the Platform requires an active subscription. Available plans and their prices are detailed on the Pricing page. Prices are shown in US dollars (USD) and include applicable taxes.
Payment is processed through Stripe, a secure payment service provider. We do not directly store bank card data on our servers.
Monthly subscriptions renew automatically each month. Annual subscriptions renew automatically each year. You will receive notice before renewal if the price changes.
You may cancel your subscription at any time from your settings panel. Cancellation is effective at the end of the current billing period. No refunds are made for partial unused periods.
In case of non-payment, access to the Platform may be restricted until the debt is settled. We reserve the right to cancel the account in case of repeated non-payment.
The 14-day free trial does not require a credit card. At the end of the trial period, you must subscribe to a paid plan to continue using the service.
Data entered by your Organization into the Platform is and remains your property. MaxyonOps acts solely as a data processor on your behalf.
By using the Platform, you grant us a limited, non-exclusive, non-transferable license to process your Data solely for the purpose of providing the service.
The software, design, algorithms, source code, documentation and all other elements of the Platform are the exclusive property of MaxyonOps and are protected by applicable intellectual property law.
Upon account cancellation, you may request an export of your Data within 30 days of cancellation. After that period, data may be permanently deleted from our systems.
The Platform is provided "as is" and "as available". We make reasonable efforts to ensure the availability and proper functioning of the service, but we do not offer absolute guarantees of continuous or error-free availability.
In no event shall MaxyonOps be liable for indirect, incidental, special or consequential damages resulting from the use or inability to use the Platform, including loss of profits, data, business or reputation.
Our total liability for any claim shall not exceed the amount paid by the Organization in the 3 months prior to the event giving rise to the claim.
We are not responsible for losses caused by User errors, misuse of the Platform, unauthorized access due to User negligence, or failures of third-party services.
We commit to maintaining the confidentiality of your Organization's Data and not disclosing it to third parties except with your express consent, by legal obligation, or to the extent strictly necessary for service delivery (e.g., infrastructure providers).
All our employees and collaborators with access to customer data are subject to confidentiality obligations.
We may modify, update or discontinue any feature or aspect of the Platform at any time. We will notify significant changes with reasonable advance notice.
We may update these Terms when necessary. We will notify material changes by email or through a notice on the Platform. Continued use after notification implies acceptance.
These Terms are governed by the applicable law at the registered office of MaxyonOps. Any dispute arising from the interpretation or application of these Terms will first be attempted to be resolved amicably.
If an amicable solution is not reached within 30 days, the parties shall submit to the jurisdiction of the competent courts at the provider's domicile, expressly waiving any other jurisdiction.
